Summary: Work permit
Every employer, planning to employ a citizen of a country from outside the European Economic Area (EEA) must apply for a work permit. This work permit is only valid for a specific employer and for a specific employee. Permits are issued for a maximum of three years. Employers seeking to employ foreign nationals must comply with the rules laid down in the aliens Employment Act (WAV).
Foreign nationals who want to work in the Netherlands must have a work permit in order to qualify for a (temporary) residence permit. The application process for the work permit and (if applicable) for the temporary residence permit (Machtiging tot Voorlopig Verblijf/MVV) can be started simultaneously. When the work permit expires, the residence permit will also no longer be valid.
The employer should apply for a work permit before the applicant moves to the Netherlands at the Center for Work and Income (CWI), located in Zoetermeer, tel. +31 (0)79 3712903.
With the exception of internal transfers, work permits are granted only if the employer can demonstrate that he has not been able to fill the vacancy through recruitment within the Netherlands or the European Economic Area. The job opening must be reported to the Center for Work and Income (CWI) and must advertise the vacancy in newspapers, and efforts for finding a suitable candidate in the European job market can be made with the assistance of the European Employment Services (EURES), which is also available at the Center for Work and Income.
There are also separate work permits for trainee students and work placements.
