Summary: Application of Work permit
In order to get a work permit, work-permit application form AV 320 must be completed and signed by applicant and employer and returned to the Center for Work and Income (CWI). The following documents must be submitted:
- A copy of the applicant's passport;
- A labor contract;
- A statement of the applicant's salary;
- A guarantee that the applicant will return to the home country after a certain period;
- A resume of the applicant;
- An extract from the trade register of the Chamber of Commerce (in the Netherlands);
- All relevant diplomas and certificates of the applicant.
- Only when applicable: a filled-in copy of the applicant's MVV-application;
- Only when applicable: a filled-in copy of the attachment to form AV 320 in the case of internal transfers, trainee students and work placements;
- Only in the case of an internal transfer: a transfer statement given by the applicant's company, including a description of the project the applicant is going to carry out (with an indication of the length of period).
If a work permit is granted, CWI sends it to the company where the employee will be employed, who provides the foreign employee with a copy of the work permit.
Once the foreign national enters the Netherlands, depending on the land of origin, he should be able to show that he does not have tuberculosis (excl. citizens from one of the countries of the European Union, from Australia, Canada, Iceland, Israel, Japan, Monaco, New Zealand, Norway, Suriname, Switzerland (including Liechtenstein) or the United States). The foreign national must have comprehensive health insurance that covers all risks in the Netherlands.
If an employee of a foreign company who is to be transferred to the Netherlands has been granted a work permit, his or her partner is also entitled to apply for a work permit, which will not be issued before the employee of the foreign company has acquired his or her residence permit. The partner's work permit is valid only as long as the work permit of the foreign national is valid.
The partner is required to produce the following documents:
- A filled-in copy of form AV 320
- A copy of the applicant's passport
- A notarized/apostiled marriage certificate
- A copy of the residence permit of the partner who already works for the international company
- An extract from the trade register of the Chamber of Commerce of the company the partner is going to work for.
- A labor contract
- A resume
- All relevant diplomas/certificates
- Only when applicable: a filled in copy of the MVV-application
